The list of nationalities that require a visa before arrival is maintained by the Home Office. Those nationalities not included in this list fall into the category of 'non-visa nationals' and are usually permitted to enter as a visitor upon arrival. You will only be eligible for an extension if you are still employed by the same employer who sponsored your initial visa application. Furthermore, the headquarters of the parent company that sponsored your visa must still be located outside of the UK.

Therefore, it is crucial to keep track of the licence's expiry date and begin the renewal process well in advance to ensure the continuation of these activities seamlessly. Failure to renew the licence on time can lead to penalties, and sponsored employees may risk having their visas curtailed.
If your application for a sponsor licence is not approved, the next steps will depend on whether the Home Office "rejected" or "refused" your application and the reasons for their decision. The difference between the two terms is not just a matter of semantics; it can have a significant impact on your company's ability to sponsor skilled migrants in the short term.
Businesses that employ individuals who do not have the right to work in the UK can be fined through a civil penalty. This fine serves as a way to deter and enforce compliance with immigration regulations. There are two types of notices related to these penalties, including a Referral Notice which informs the employer of a potential penalty and initiates an investigation, and a Civil Penalty Notice which specifies the reason for the penalty and the amount of the fine. Employers can choose to pay the penalty, appeal the decision, or request instalment payments for the penalty.

1. It is important to ensure that migrant workers have the legal right to work and possess the necessary professional qualifications. Copies of their qualifications should be kept on file and made available to the Home Office if requested.

2. It is crucial to avoid hiring migrant workers who do not have the appropriate immigration status. If a worker becomes ineligible for any reason, their employment should be terminated.

3. Certificates of Sponsorship (CoS) should only be issued to migrants who meet the requirements of the PBS tier or category under which the certificate is issued. It is essential to ensure that all CoS holders meet the necessary criteria.
